Diner Perks is Silver Diner’s new rewards program for the entire family where you can earn points and rewards for what you eat. You will receive free food, exclusive offers, birthday rewards, and other surprises. Up to five people, including you, can share one family account. Plus, Diner Perks has a special program for children 12 years and younger, so they can earn perks too!

You earn 1 point for every $1 spent when you dine-in, order carryout and order online SilverDiner.com. Just check in with your phone number, mobile app or smart wallet. And if you accumulate 500 points in a calendar year, you are automatically upgraded into our Chrome tier where you receive extra perks.
We’re sorry you cannot earn points on alcohol, gift cards, merchandise, delivery fees, marketplace fees, utensils/packaging fees, donations, tax, service fees, tips and some other items.

1. INTRODUCTION
These Diner Perks Rewards Program Terms & Conditions (the “Rewards Terms”) govern your participation in the Diner Perks Rewards Program (the “Rewards Program”) and constitute a binding agreement between you and Silver Diner Development LLC (“Silver Diner,” “we,” “our” or “us”), which owns and operates the Rewards Program. The Rewards Program offers participants the opportunity to earn special food and beverage offers and to unlock additional perks at participating Silver Diner locations (“Participating Restaurants”).
In addition to these Rewards Terms, participation in the Rewards Program is subject to our Terms of Use. For clarity, this Rewards Program constitutes one of Silver Diner’s “Services” and these Rewards Terms constitute “Additional Terms,” as each of those terms in defined in the Terms of Use. Capitalized terms used but not otherwise defined in these Rewards Terms have the meanings attributed to them in the Terms of Use.
Please read these Rewards Terms and the Terms of Use carefully. Among other provisions that affect your legal rights, the Terms of Use include a binding individual arbitration requirement and class action waiver, which, subject to limited exceptions, requires you and Silver Diner to arbitrate any Disputes on an individual basis. Arbitration on an individual basis means that neither party will have the right for a judge or jury to decide its claims or to proceed in a class, consolidated, or representative capacity
By (a) accepting these Rewards Terms using a mechanism made available on the Sites (such as by clicking an “I Agree” button or checking a box) or (c) otherwise participating in the Rewards Program, including by creating an Account, you expressly represent that you agree to be bound by these Rewards Terms and the Terms of Use.
2. ELIGIBILITY & ENROLLMENT
a. Eligibility
Age Requirements. Participation in the Rewards Program requires an Account, which can be created free of charge via the Sites. To create an Account, you must be at least 18 years old. Individuals ages of 13 to 17 may participate in the Rewards Program solely as a designated Family Member on a Family Account, and such participation must, at all times, occur under the supervision of a parent or legal guardian who has agreed to these Rewards Terms and the Terms of Use. Individuals under the age of 13 are strictly prohibited from participating in the Rewards Program or otherwise using the Services.
Reservation of Rights. We may refuse any application for enrollment in the Rewards Program, or suspend or cancel any Account or a Program Member’s participation, at any time and for any reason, including if we determine that a person (i) is not eligible to participate; (ii) has engaged in any actual or suspected fraud, deception, or conduct not in the spirit of the Rewards Program; or (iii) has violated these Rewards Terms, the Terms of Use, or any law or regulation.
b. Family Accounts
Adding Family Members. If you create an Account (such individuals, "Account Holders"), you have the option to designate your Account as a family account (a "Family Account"), which allows you to add up to five (5) family members (each, a "Family Member") to the Account for purposes of participating in the Rewards Program. The right to designate a Family Account and to add Family Members belongs solely to the Account Holder. To be eligible for Family Member-status, an individual must (i) be at least thirteen (13) years of age; (ii) be an immediate family member of, or reside in the same household as, the Account Holder; and (iii) have expressly agreed to these Rewards Terms and the Terms of Use. The Account Holder and each Family Member (if any) on an Account are referred to as a “Program Member.”
Family Account Limitations. Only one Family Account is permitted per household. In addition, a person may participate in only one Family Account at a time, whether as an Account Holder or as a Family Member. We reserve the right to suspend, terminate, or merge Family Accounts that we reasonably believe violate the foregoing requirements.
Account Holder Representations. If you, as an Account Holder, add a Family Member to your Account, you represent, warrant, and agree that: (a) such Family Member has reviewed and agreed to the Rewards Terms and the Terms of Use ; and (b) for any minor Family Member, you (i) are the parent or legal guardian of such individual or otherwise authorized to share such individual’s personal information in connection with the Rewards Program and (ii) will supervise and assume legal responsibility such individual’s participation in the Rewards Program.
Account Credentials. Notwithstanding the prohibition on sharing Account credentials set forth in the Terms of Use, an Account Holder is permitted to share Account credentials with designated Family Members. Nonetheless, the Account Holder is responsible for all activities that occur under a Family Account, including any activities of Family Members, and accepts all risks of unauthorized access arising from sharing Account credentials with Family Members.
3. PROGRAM BENEFITS
a. Points
Earning Points. An Account earns one (1) Rewards Program point (“Points”) for each one dollar (US $1.00) of Qualifying Purchases made by a Program Member on that Account. Points are calculated based on the pre-tax purchase amount, excluding taxes, gratuities, service charges, and any other added fees. Points are rounded to the nearest whole Point; we do not award fractional Points. To earn Points, the applicable Program Member must be logged into the Account or otherwise identify the Account at the time of the Transaction in the manner we specify.
Qualifying Purchases. "Qualifying Purchases" are all purchases of food and beverages at Participating Restaurants, except for any purchases we designate as non-qualifying such as alcohol, gift cards, merchandise, delivery fees, service fees, marketplace fees, donations, utensil/packaging fees, tax, tips and employee discounts.
Bonus Points. In our discretion, we may award bonus Points or otherwise offer promotional opportunities to earn Points outside of Qualifying Purchases (collectively, "Bonus Points"). Except as we provide otherwise, Bonus Points are treated as standard Points for all purposes of these Rewards Terms, including counting toward the one hundred fifty (150) Points required to receive an Earned Offer.
Point Totals. An Account’s “Point Total” is the current number of Points in the Account that count toward the next Earned Offer. The Point Total is distinct from Annual Points, which are addressed in Section 3(c). The Point Total is updated after each Qualifying Purchase, other Point-earning activity, or refund or adjustment has been processed. The time this takes will vary but will usually be within 1 hour from the time of the Transaction is paid, completion of the applicable Point-earning activity, or refund or adjustment. A Family Account has a single Point Total; Points are not tracked or held separately for each Program Member.
Refunds and Adjustments. If a Qualifying Purchase is later refunded or reversed, in whole or in part, we will deduct from the Account any Points earned on the refunded or reversed amount
Expiration. Points expire three hundred sixty-five (365) days after they are earned, unless we provide otherwise. For purposes of these Rewards Terms, Points are “earned” on the date they post to the Account
b. Offer
Offers. An “Offer” is a promotional reward that a Program Member can redeem at one or more Participating Restaurants and may include a discount, free food or beverage, opportunity to complete a specified activity to receive a reward, or other deals. Offers may vary from time to time. Not all Offers will be available to all Program Members, and Offers may not be available for redemption at all Participating Restaurants. A particular Offer may be available only in limited quantities and on a first-come, first-served basis. We may limit, condition, or vary any Offer, change the form of any Offer, and discontinue any Offer in our discretion.
Ways to Receive Offers. For every one hundred fifty (150) Points accrued in an Account, the Account receives one (1) Offer (an “Earned Offer”). We may also, in our sole discretion, provide Offers to some or all Program Members as a special reward, regardless of the number of Points in the Account (each, a “Discretionary Offer”). The type, form, and value of each Offer, and its Offer Terms, are determined by Silver Diner in its sole discretion and may vary on a selective or targeted basis. As such, the Earned Offer issued to one Account upon accruing one hundred fifty (150) Points may differ from the Earned Offer issued to another Account.
Offer Terms. Each Offer has its own terms and conditions, which may address, among other things, the reward provided, eligibility, availability, minimum purchase requirements, expiration, and how the Offer may be redeemed (the “Offer Terms”).
Expiration. Unless the Offer Terms state otherwise, an Offer expires ninety (90) days after it is added to the Account.
Redemption. An Offer may be redeemable in person at a Participating Restaurant, in an online order, or both, as specified in the Offer Terms. An Offer may be redeemed only once. To redeem an Offer in person, a Program Member must select the Offer in "My Offers" in the Account to generate a QR code, which is then scanned at a Participating Restaurant. The QR code must be used within two (2) hours after it is generated. If it expires before it is used, the Program Member can return to "My Offers," reselect the Offer, and generate a new QR code. To redeem an Offer in an online order, a Program Member must review the Account's available Offers during the checkout process and apply the relevant Offer to the Order. An Offer that is not selected before the Order is placed will not be applied to that Order
c. Status Tiers & Perks
Annual Points. "Annual Points" are the total Points earned on an Account during a given calendar year (January 1-December 31) and are calculated solely for the purpose of determining an Account’s Status Tier. Annual Points are not reduced by the conversion of Points into Offers. Unless we provide otherwise, Bonus Points are included in Annual Points.
Status Tiers. When an Account’s Annual Points reach a threshold set forth in the table below during a calendar year, the Account enters the corresponding tier (each, a “Status Tier”) and becomes eligible for the Perks associated with that Status Tier for the remainder of that calendar year. Status Tiers are not cumulative. When an Account advances to a higher Status Tier, it ceases to be eligible for the Perks associated with the prior Status Tier and becomes eligible only for the Perks associated with the new Status Tier.

Perks. A “Perk” is a benefit, privilege, feature, or enhanced experience that we make available to an Account upon reaching a Status Tier. A Perk may not be available at all Participating Restaurants and may be subject to its own terms and conditions. The specific Perks associated with each Status Tier are described on a dedicated page on silverdiner.com/diner-perks and may be added to, removed, modified, or otherwise changed by us from time to time in our sole discretion. The Perks in effect at any given time are those set forth on that page, which is incorporated into, and forms part of, these Rewards Terms.
Reset of Annual Points and Status Tier. Unless we provide otherwise, at the beginning of each calendar year an Account’s Annual Points reset to zero (0), and any Status Tier the Account reached in the prior calendar year remains in effect. Thus, an Account holds maintains the Status Tier at the beginning of a calendar year. and must accumulate Annual Points during that year to maintain a Status Tier into the beginning of the next calendar year. The reset of Annual Points affects Status Tier qualification only. It does not remove or reduce the Points in your Account that are available to earn Offers, which expire as described in Section 3(b). We may change the Status Tiers, the Annual Points thresholds, and the associated Perks at any time.
d. GENERAL
No Cash Value or Transfer. Points, Offers, Status Tiers, Perks (collectively, "Program Benefits") have no cash value and are not redeemable for cash. Program Benefits do not constitute money, property, or any other form of legal tender or credit and cannot be purchased, sold, assigned, transferred, gifted, bartered, or combined across Accounts. Any attempt to do so is void.
Per-Transaction Limit. Unless we provide otherwise, only one (1) Program Benefit may be applied to any single transaction or check (each, a "Transaction"). For example, multiple Program Benefits (e.g., multiple Offers or an Offer and a Perk) cannot be combined with one another, or with any other promotion, coupon, or discount that we offer, on the same Transaction.
No Guarantee of Availability. All Program Benefits are determined by Silver Diner in its sole discretion. We make no representation or guarantee regarding any Program Benefit, including whether any particular Program Benefit will be available at any particular time, or at all, or the length of time that any Program Benefit will remain available.
Privacy. As set forth in the Terms of Use, all personal information provided to us in connection with the Services, including the Rewards Program, will be handled in accordance with our Privacy Policy.
Adjustments and Reserved Rights. We may modify, adjust, revoke, or cancel Program Benefits that we reasonably believe were earned or used in error, through fraud, in violation of these Rewards Terms or the Terms of Use, or otherwise in a manner inconsistent with the intended operation of the Rewards Program. We are solely responsible for determining the proper Point Total and Annual Points of an Account, and our determination is final. If a Program Member has already used any Program Benefit that we determine was earned, issued, or used improperly, we reserve the right to take any reasonable corrective action.
Program Cancellation or Modification. We reserve the right to modify, suspend, or discontinue the Rewards Program, in whole or in part, at any time and for any or no reason. If we discontinue the Rewards Program, you understand and agree that all Program Benefits will be immediately forfeited and irrevocably removed and you shall be entitled to no compensation of any kind in connection with the same.
Inactivity. If an Account has no Qualifying Purchases or other Program activity initiated by a Program Member for a continuous period of two (2) years, we may treat the Account as inactive and remove it from the Rewards Program. Upon removal, all Program Benefits associated with the Account are forfeited and will be irrevocably removed, and the Account will no longer participate in the Rewards Program unless it re-enrolls in the manner we specify.
Effect of Termination. If these Rewards Terms or the Terms of Use are terminated for any reason, or if your Account is suspended, terminated, or removed from the Rewards Program, all Program Benefits associated with the Account are immediately forfeited and will be irrevocably removed. Silver Diner will not compensate you for any forfeited Program Benefits. For the avoidance of doubt, the termination provisions of the Terms of Use apply to your participation in the Rewards Program.
Additional Rewards Terms. From time to time, we may present additional terms, rules, or guidelines in connection with particular aspects of the Rewards Program (collectively, “Additional Rewards Terms”). The Additional Rewards Terms are incorporated into, and form part of, these Rewards Terms. As such, any reference to the “Rewards Terms” herein includes the Additional Rewards Terms. Offer Terms and the terms and conditions of Perks are Additional Rewards Terms. In the event of a conflict between these Rewards Terms and any Additional Rewards Terms, the Additional Rewards Terms will control.

After swiping your card for a point, your server will bring back your card along with a sealed envelope.

The Silver Diner Kids Club is for individual customers, 12 years or younger. To qualify for points individual kids club members must be present, and present their card at the time of purchase. Members must register their accounts to collect points. Registered members can earn one point per visit with a minimum dine-in purchase of $4.99 per member per visit (excluding tax and tip) at all participating Silver Diner restaurants. Points cannot be earned for carryout out, online or delivery orders. Certain restrictions apply.
Points do not expire but can be redeemed for a complimentary kids entree reward after earning five points.
Kids Club rewards can be combined with one instant prize. Instant prizes are not valid in conjunction with any other instant prizes, discounts and promotional certificates.
Silver Diner reserves the right to add or withdraw participating restaurants, to make changes in the rules or prizes, audit or cancel your account, or terminate the program at any time without advance notice. Yes. The current Eat Well, Do Well club is ending at the end of July and becoming Diner Perks. If you are an active Eat Well, Do Well member, you can create a Diner Perks account using the same email address and phone number as your Eat Well, Do Well account.

An account allows you to access and modify your order after it has been placed. If you do not have an account (sign in as a guest) you cannot modify the order once it has been placed.

Car Hop is our curbside service. We will deliver your order to your car. There is no need to come inside.

Silver Diner utilizes third party services for delivery. The delivery area is determined by the delivery company and based on the amount of time it takes to deliver the food. The delivery radius may change depending on traffic conditions.

Yes. All of our Silver Diner locations offer delivery.

Delivery hours are based on the location’s operating hours. Delivery is typically available 30 minutes after opening and up to one hour before closing. Please refer to the store hours at silverdiner.com

Yes. The third-party service provider charges a fee based on distance and demand. The average charge is $5.99 and we pass that along to the guest. We do not charge a service fee.

Almost all items are available for delivery except the breakfast and lunch blue plate specials. These items are available for dine-in only, Monday to Friday, from open until 4pm.

Yes. You can place an online order up to 7 days in advance.

When the order arrives at the location, it arrives as a closed check so we are not able to make changes.
If the change is simple with no-additional-charge, we would be happy handle it.
If the change requires an additional charge we will need to ring it on a new separate ticket.

Removing an ingredient or substituting a similar ingredient that doesn’t have an upcharge. For example, removing tomato from a burger or substituting mixed vegetables for the fries is a simple no-additional charge change. If you want to substitute sweet potato fries or add cheese, there is an upcharge and we will need to ring it on a separate new ticket (manager’s discretion).

Substitutions or removal of the natural choices of a menu item are allowed. We automatically listed a range of natural substitutions for each menu item. For example the Bacon Bleu Burger will ask which of the ingredients you want to remove and which side you would you would like to have. If you substitution is not listed, we recommend calling the location to modify your order.

No. We recommend using 110% certificates to dine at our restaurant. If you would like to use a Silver Diner 110% certificate for To Go, please call the Silver Diner location and place the order over the phone for carryout or car hop.

No. Once the order is received the check is closed. For great service, you can tip the to go attendance or driver in cash.

No. You can either pay by credit card or gift card on SilverDiner.com or you can pay by credit card, Apple Pay or Google Pay using our Text 2 Pay service.

ISSUES OR REFUNDS

If you are placing an ASAP order you will not be able to cancel the order, since the order immediately goes to our kitchen. However, you can cancel a future order from the Silver Diner mobile app.

Please contact Guest Relations within 72 hours (3 days) of the issue. To expedite the resolution, provide the following information: 1) Order Number, 2) Date, 3) Location, 4) Contact Information and 5) Description of the Issue. If you are an Eat Well, Do Well member, please provide your account number so we can expedite the resolution.

If you contact the location after the food has been made, we will be unable to cancel or refund the order since the order has been fulfilled.
